Wittmann Digital s.r.l. (henceforth also 'Wittmann') is committed to protecting the privacy of users. Please read the following privacy policy to understand how your personal information will be processed when you use or register on www.wittman.digital, talk to a

member of our Customer Services, or otherwise interact with Wittmann.

1. Subject of processing and data controller

The personal data that you provide to Wittmann, as well as any sensitive data that you may have communicated, will be processed in accordance with the aforementioned legislation and confidentiality obligations exclusively for the purposes set out in point 2 below. Wittmann collects personal information when this is provided directly by the user or through the use of the website, for example:

  • Information about the user and the company the user works for, when creating an account for the site. This could include the user's name and contact details, the name and details of the company, information about your role in the company and how you found out about the site.
  • Information on transactions, invoicing and deliveries, if a product or one of our services has been purchased.
  • Record of user interactions with us, e.g. sending feedback via e-mail on our website, requesting a technical clarification, reporting a problem or other. Note that in the case of telephone calls, the conversation may be recorded for reasons of legal compliance or for quality assessment or staff training purposes.
  • If you interact with one of our sales agents, e.g. at a trade fair or the customer's premises.
  • We may also record certain details about how our website is used, such as the website previously visited or to which the user subsequently switches, the unique ID of the device used, IP addresses and operating system, clicks on advertisements, products searched, products purchased and information downloaded. The marketing e-mails sent may also automatically detect whether the e-mail was received or opened and whether a link contained in the marketing materials was used. 2. Purpose and method of processing

The purpose of the processing is solely for the correct and complete execution of the contract concluded with Wittmann and, in particular, for the purposes set out below:

  • To process the order placed and/or provide the services purchased.
  • To manage the account online.
  • To handle and answer questions or complaints submitted to our Customer Service team.
  • To improve and manage the Wittmann website.
  • For market research.
  • To send marketing messages and display targeted advertisements, having the user's consent or being otherwise authorised.
  • To implement and improve the services offered, in terms of troubleshooting, improving the performance of the software, and improving through upgrades.
  • For security purposes, to investigate fraud and where necessary to protect ourselves or third parties.
  • To comply with legal and regulatory obligations.

The processing of data carried out by Wittmann involves the collection, recording, storage, consultation, processing, communication, modification, use, deletion/destruction of personal data (whether identifying, sensitive and/or judicial) concerning you.

As well as on paper, the processing may be carried out with or without the aid of electronic or otherwise automated tools.

The Data Controller shall process personal data only for as long as is necessary for the performance of the professional tasks for which they were provided and, in any case, no longer than ten years after the termination of the professional relationship, with an undertaking to delete/destroy them after that period.

3. Data Communication

Without the need for express consent (pursuant to Art. 24 (a), (b), (d) Privacy Code and Art. 6 (b) and (c) of EU Regulation No. 679/2016), Wittmann may disclose your data to Supervisory Bodies, Judicial Authorities, Insurance Companies, as well as to any other entity to which disclosure is mandatory under specific legal provisions.

Your data will not be disclosed to third parties without your specific consent.

Finally, Wittmann may share the data provided with employees, collaborators, consultants and external experts and, more generally, with all those public and private parties to whom it is necessary to communicate the data in order to correctly fulfil the purposes for which the contract was concluded.

Wittmann may also disclose personal information if it believes that such disclosure is necessary to protect the rights, property or personal safety of Wittmann, its customers or employees, or the public, or when otherwise authorised by law.

4. Data Retention

Wittmann is an internationally active company. Therefore, personal information may be processed in non-European countries, including countries where legal protections in this regard may be weaker than in the candidate's country of residence. If we transfer personal data outside the European Economic Area (EEA), we will ensure, as required by applicable law, that privacy rights are adequately protected using appropriate safeguards. We retain personal information for as long as necessary for the purposes mentioned above, this period may therefore vary depending on the interactions with you. For instance, when a purchase has been finalised, we keep a copy for the period necessary for invoicing, taxation and possible warranty coverage. We may also keep a copy of correspondence between you and us, for example if a complaint has been made about a product, for as long as is necessary to protect us from a legal claim. The moment we no longer need to store information, it will be deleted.

5. Protection of personal data

Wittmann's goal is always to offer the highest level of service and security to its customers, and the www.wittmann.digital site was designed specifically to be a safe place. Wittmann guarantees the security and protection of personal data and sensitive information provided. Account and personal online profile information is password-protected so that only the user can access it. 6. Use of data for marketing purposes

Unless the option is declined during account registration and purchase, Wittmann may send e-mails or text messages or call the user on the telephone to advertise products and services. It is likely that some or all of these marketing messages will be tailored to the user's preferences, defined by what we know about the user and/or the company the user works for and derived, for example, from the user's personal online profile, previous searches and browsing history on the Wittmann site and purchasing activity.

The user may view Wittmann's commercial advertisements on third-party websites, including social media. These commercial alerts may be tailored to the user's interests through the use of cookies (which track web activity to enable us to propose commercial alerts to customers who have visited the Wittmann website). The display of commercial alerts on social media may take place on the basis of an agreement between Wittmann and the social network that provides for the display of commercial alerts to our customers or users that match the demographic profile of our customers. In some cases, this may involve sharing the user's e-mail address with the social network. 7. Rights of the data subject

In your capacity as data subject, you may obtain confirmation of the existence of personal data concerning you, its origin, the purposes for which it is processed and the manner in which it is processed, as well as the identification details of the data controller. Wittmann will comply with any request to exercise such rights in accordance with applicable law. However, bear in mind that there are a number of limitations to these rights and that there may be circumstances in which we would not be able to comply with the request.
